Welcome to CompliObs, a digital observation management platform operated by SVIDA Pty Ltd (“SVIDA”, “we”, “our” or “us”).
By accessing or using the CompliObs website, mobile application or related services (“Services”), you agree to these Terms of Use. If you do not agree, please do not use the Services.
1. Use of the Services
CompliObs is designed to assist care providers to record, manage, monitor and report on participant and patient observations electronically.
You agree to:
- Use the Services only for lawful purposes.
- Keep your login credentials secure.
- Ensure information entered into the system is accurate and up to date.
- Comply with all applicable laws, regulations and privacy obligations.
- Not attempt to gain unauthorised access to the Services or related systems.
2. Account Responsibility
You are responsible for:
- Maintaining the confidentiality of your account credentials.
- All activities performed under your account.
- Promptly notifying us if you believe your account has been compromised.
3. Clinical and Care Information
CompliObs assists organisations with recording and managing observations. The platform does not provide medical advice, diagnosis or treatment.
Users remain responsible for:
- Assessing clinical information.
- Making care decisions.
- Escalating concerns to appropriate healthcare professionals when required.
4. Data Ownership
Your organisation retains ownership of the data entered into CompliObs, including participant, patient, staff and observation records.
SVIDA does not claim ownership of customer data.
You grant us permission to store, process and transmit your data solely for the purpose of providing and supporting the Services.
5. Service Availability
We aim to provide reliable access to the Services but do not guarantee uninterrupted or error-free operation.
We may perform maintenance, updates or improvements from time to time which may temporarily affect availability.
6. Intellectual Property
All software, branding, logos, content and intellectual property associated with CompliObs remain the property of SVIDA Pty Ltd or its licensors.
You may not copy, modify, reverse engineer, distribute or create derivative works from the Services except as permitted by law.
7. Limitation of Liability
To the maximum extent permitted by law:
- The Services are provided on an “as available” basis.
- SVIDA is not responsible for indirect, incidental or consequential loss.
- Our liability is limited to the amount paid by you for the Services during the preceding 12 months.
Nothing in these Terms excludes rights that cannot be excluded under Australian law.
8. Termination
We may suspend or terminate access where:
- These Terms are breached.
- There is unauthorised or unlawful use of the Services.
- Subscription fees remain unpaid.
Upon termination, access to the Services may cease, subject to any data retention obligations.
9. Changes to These Terms
We may update these Terms from time to time. Continued use of the Services after changes are published constitutes acceptance of the updated Terms.
